Does your Business Conform to Current ADA Requirements?

ADA is a familiar acronym for The American Disabilities Act that the U.S. Congress passed in 1990 and amended in 2008. The ADA prohibits discrimination and mandates equal access for persons with disabilities to employment, transportation, state and local government services, public accommodations, and commercial facilities. The last two on the list are our primary concerns at Brown’s Lock shop & Maintenance. we help  architects, contractors, builders and business owners to comply with ADA requirements in building of all sizes.

Section 4.13.9 of the ADA addresses door hardware, and it says “Handle, pulls, latches, locks and other operating devices on accessible doors shall have a shape that is easy to grasp with one hand and does not require tight grasping, tight pinching, or twisting of the wrist to operate.”

Basically, if the potential exists for someone or customer to visit your facility, you need to be in compliance.

The act has no grandfather clause, it stipulates, that in existing structures, barriers to entry or services must be removed if” technically feasible.”  And cost is not a factor in determining whether an action would be technically feasible.    

Although the Minimum fine is over $55,000 for the first offense, there may be a tax credit or incentives for upgrading to ADA compliant hardware.
